Waiver & Release of Liability

This Waiver & Release of Liability (“Agreement”) is entered into between Vitamin Sea Fishing Charters (“Company,” “we,” “our,” or “us”) and the undersigned participant (“Guest,” “you,” or “your”). By signing this document, you acknowledge and agree to the following:

1. Assumption of Risk

I understand that fishing, boating, and related activities involve inherent risks, including but not limited to:

  • Slips, trips, and falls on docks, boats, or lodging premises.

  • Weather-related hazards, including storms, waves, and lightning.

  • Risks associated with the use of fishing equipment, hooks, lines, and tackle.

  • Potential injury from fish, wildlife, or water conditions.

  • Transportation to and from the dock.

I voluntarily assume all risks of participating in fishing and boating activities with Vitamin Sea Fishing Charters.

2. Release of Liability

In consideration of being permitted to participate, I release and discharge Vitamin Sea Fishing Charters, its owners, employees, agents, contractors, and affiliates from any and all claims, demands, actions, or causes of action related to:

  • Personal injury, illness, or death.

  • Loss, theft, or damage to personal property.

  • Any other liability arising out of my participation, except in cases of gross negligence or willful misconduct by the Company.

3. Medical Fitness

I certify that I am physically fit to participate in fishing and boating activities. I have no medical conditions that would increase the risks of participation. I will disclose any relevant medical conditions to the captain or crew prior to departure.

4. Compliance with Instructions

I agree to follow all safety instructions given by the captain and crew, including the use of safety equipment such as life jackets. Failure to comply may result in termination of the trip without refund.

5. Minors

If I am signing on behalf of a minor (under 18 years old), I certify that I am the parent or legal guardian and that I consent to their participation under the same terms as listed above.

6. Photographs & Media

I grant permission to Vitamin Sea Fishing Charters to use photographs or videos taken during the trip for promotional purposes, unless I provide written notice opting out.

7. Governing Law

This Agreement shall be governed by and construed under the laws of the State of Ohio.

8. Acknowledgment

By signing below, I confirm that I have read and understood this Waiver & Release of Liability. I voluntarily agree to its terms.
